A Scottish nurse has partially succeeded in a high-profile harassment claim over sharing a female changing room with a transgender doctor, after an employment tribunal ruled that the NHS’s handling of her complaint crossed the line into unlawful harassment, even though most of her claims failed and the doctor was cleared.
The judgment runs to 312 pages and was described by the tribunal itself as dealing with “novel and complex” issues and as “unusually lengthy”, underlining how contentious the case has been.
Tribunal finds limited harassment over handling of complaint
The case centred on nurse Sandie Peggie, who holds gender critical beliefs, and a trans woman junior doctor who had been permitted by NHS Fife to use the female staff changing room at Victoria Hospital in Kirkcaldy.
The tribunal found that Peggie was harassed by the health board in four situations, all related to how it responded after she raised concerns and after a Christmas Eve/Christmas Day 2023 encounter in the changing room:
