'Can't cope' | Tribunal backlog will only worsen without intervention, employment lawyers warn

The UK’s leading authority on employment law has issued a call to the Government to address the avalanching backlog of employment tribunal cases before new legislation worsens delays. 

The Employment Lawyers’ Association is apolitical but comments on the consequences of the Government’s policy choices.

New Employment Tribunal statistics reveal a bleak picture of the Tribunals being unable to cope with the rising tide of employment litigation. Open cases involving individual employees and businesses increased from 33,000 to 45,000 – almost a 40% increase.

As the Tribunal, on its current funding, has only dealt with about 32,000 individual cases in each of the last two years, the Government has knowingly sentenced the Tribunals to an increase of open cases of about 13,000 per year.
