Agency worker protection
“The extended definition of a worker provides that, for the purposes of whistleblowing protection, an agency worker or person supplied by a personal service company will receive protection where the terms on which they were engaged were 'substantially determined' by another party (e.g. the employment agency or the end user to whom the person is supplied).
“The worker will receive protection against any organisation that 'determined or substantially determined' the terms on which they are engaged. What this means is that, if rather than the worker being in control of matters (such as when they work and what they are paid) a third party is, the worker may have 'whistleblower protection' against that third party.”
