Why Starbucks discrimination case is a warning to employers

Last week HR Grapevine reported on a Starbucks employee who won a disability discrimination case against her employer after she was accused of falsifying documents. 

The worker, Meseret Kumulchew, argued to a tribunal that Starbucks had acted unfairly towards her after she made several mistakes on work forms. Kumulchew has difficulties reading, writing and telling the time, which meant she struggled with certain tasks assigned to her. The tribunal agreed with her. 

Speaking to HR Grapevine, Julie Taylor, Employment Solicitor at Gardner Leader, says: “Whether you employ disabled staff or not, all employers must comply with the requirements of the Equality Act from the start of the recruitment process right up until the employee leaves the job.”
